Computer Repair Service Agreement & Terms and Conditions

Covenant Computers and I.T. LLC · Ozark, Alabama · Effective

This Computer Repair Service Agreement ("Agreement") is entered into between Covenant Computers and I.T. LLC ("Company," "we," "our," or "us") and the customer identified on the accompanying work order ("Customer," "you," or "your").

By authorizing repair services, dropping off equipment, or signing the work order, you agree to the following terms and conditions.

In-shop service is governed by the signed work-order agreement.

1. Authorization

You authorize Covenant Computers and I.T. LLC to diagnose, repair, upgrade, configure, recover data from, or otherwise service your equipment as described on the work order.

You represent that you are the legal owner of the equipment or have authority from the owner to authorize repairs.

2. Estimates

All estimates are based on visible or initially diagnosed issues.

Additional problems may be discovered during repair. If additional work is required that exceeds the approved estimate, we will attempt to contact you for authorization before proceeding.

Estimates are not guarantees.

3. Diagnostic Fees

Diagnostic fees may apply regardless of whether repairs are approved.

Diagnostic fees are non-refundable and compensate the Company for technician time and testing.

4. Payment

Payment is due immediately upon completion of services and before the equipment is released.

Accepted payment methods include those displayed by the Company at the time of payment.

Failure to pay may result in storage charges and enforcement of the Company's legal rights described in this Agreement.

5. Abandoned Equipment, Storage Fees, and Unpaid Balances

The Company will notify you when your equipment is ready for pickup.

Equipment remaining unclaimed for more than 30 days after notification may incur storage fees of $5.00 per day unless otherwise agreed in writing.

If payment is not made, the Company may retain possession of the equipment until all outstanding charges, including repair, diagnostic, storage, and other authorized fees, have been paid in full.

If equipment remains unpaid and unclaimed after the applicable notice period required by law, the Company may exercise any rights available under applicable repairman's lien, artisan's lien, warehouseman's lien, abandoned property, or similar laws, including selling or otherwise disposing of the equipment to recover unpaid charges where permitted by law.

Any remaining proceeds, if required by law, will be handled in accordance with applicable state law.

The Customer remains responsible for any deficiency if the sale proceeds do not satisfy the outstanding balance unless prohibited by law.

6. Data Loss

The Customer acknowledges that repair procedures may result in partial or complete loss of data.

The Company strongly recommends creating a complete backup before any service.

The Company is not responsible for the loss of software, files, photographs, videos, documents, licenses, passwords, or other electronic data unless expressly agreed to in writing.

7. Passwords

The Customer agrees to provide passwords, PINs, encryption keys, recovery keys, or administrator credentials if necessary to perform requested services.

Failure to provide necessary credentials may limit or prevent certain repairs.

8. Data Privacy

The Company respects customer privacy.

Technicians will access files only when reasonably necessary to perform requested services.

Although reasonable safeguards are used, the Company cannot guarantee absolute confidentiality due to the nature of computer repair.

9. Parts

Replacement parts may be new, refurbished, or equivalent-quality components unless otherwise agreed.

The Company may substitute compatible components when original parts are unavailable.

10. Customer-Supplied Parts

The Company does not warrant customer-supplied parts.

Labor charges apply regardless of whether customer-supplied components fail.

11. Warranty

Unless otherwise stated on the invoice:

  • Labor is warranted for 90 days.
  • New replacement parts carry the manufacturer's warranty.
  • Used or refurbished parts carry only the warranty expressly stated on the invoice.

This warranty does not cover:

  • Accidental damage
  • Liquid damage
  • Electrical surges
  • Malware
  • Software corruption
  • Physical abuse
  • Unauthorized modifications
  • Damage caused after pickup

12. Limitations of Repair

Certain failures cannot be repaired.

The Company does not guarantee successful repair, virus removal, password recovery, data recovery, motherboard repair, or recovery of liquid-damaged devices.

13. Limitation of Liability

To the fullest extent permitted by law, the Company's liability shall be limited to the amount actually paid for the specific repair service.

The Company shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, business interruption, or loss of data.

14. Pickup

Equipment may only be released to:

  • The Customer;
  • A person authorized by the Customer; or
  • A person presenting acceptable identification and proof of authorization.

The Company may require identification before releasing equipment.

15. Refused Repairs

If the Customer declines recommended repairs after diagnostics have been completed, diagnostic fees remain due.

16. Force Majeure

The Company is not responsible for delays caused by circumstances beyond its reasonable control, including natural disasters, shipping delays, supplier shortages, cyberattacks, utility outages, or acts of government.

17. Governing Law

This Agreement shall be governed by the laws of the State of Alabama.

Any provision found unenforceable shall not affect the validity of the remaining provisions.

18. Annual Agreement

By signing this Agreement, the Customer acknowledges and agrees that these Terms and Conditions shall remain in effect for all services performed by Covenant Computers and I.T. LLC for a period of one (1) year from the date of signature. During this period, the Customer will not be required to sign a new Agreement for subsequent services unless these Terms and Conditions are materially revised or otherwise required by law. After one (1) year, the Customer must execute a new Agreement before additional services are provided.

19. Entire Agreement

This Agreement, together with the accompanying work order and invoice, constitutes the entire agreement between the parties.

No verbal statements or representations modify this Agreement unless made in writing and signed by both parties.
